1) * I acknowledge and agree that this is not an official wedding or registered partnership. It is a symbolic vow renewal / celebration ceremony only.
2) I agree to provide my contribution detailed above, and to photos and/or publication and/or broadcast of the Contribution in the Project. I grant to Agency and its Partners all rights including without limitation copyright, portrait rights and performers' intellectual property rights in such Contribution and all consents necessary to enable Agency and the Partners to make the fullest use of the Contribution commencing on the first exploitation date of the Campaign in perpetuity and through all media channels, including but not limited to social media channels (e.g. YouTube, Facebook, Instagram, and TikTok); (digital) out of home advertising; public relations; and digital channels.
3) I hereby waive, if and to the extent possible, the rights vested in me as referred to in the provisions of article 5, first paragraph under a to c of the Dutch Neighboring Rights Act (Wet op de naburige rechten), as well as the rights referred to in the provisions of article 25 paragraph 1 under a to c and article 45e of the Dutch Copyright Act (Auteurswet), and I will never exercise the aforementioned rights vis-à-vis Agency and/or the Partners.
4) I acknowledge and agree that Agency shall be entitled to edit, copy, add to, adapt or translate all elements of the Contribution at Agency’s discretion and I irrevocably waive in favour of Agency, the Partner(s), assignees and licensees the benefit of all moral rights and performers' rights.
5) I grant to Agency and the Partners the right to issue publicity relating to the Contribution and any other materials which may be included in it and to use and publish the Contribution, my name, photograph or likeness, and details about me as Agency deem fit without further approval by me.
6) I agree that neither Agency nor the Partners are committed to publish, broadcast, exhibit or otherwise exploit the Contribution.
7) I warrant and undertake that:
7.1 I am fully entitled to grant all rights in the Contribution to Agency;
7.2 Nothing in the Contribution shall, and I shall not do anything which might, infringe the copyright or any other right of any third party or breach any contract or duty of confidence, constitute a contempt of court or be defamatory or blasphemous or otherwise harmful to Agency’s reputation or Partners’ reputation;
7.3 I shall comply with all applicable laws, statutes, regulations and codes from time to time in force;
7.4 I am at least 18 years old;
7.5 I shall cooperate with Agency in all reasonable matters relating to the Contribution and comply with all reasonable instructions provided by Agency;
7.6 I shall keep confidential and shall not disclose to any third party or publish on any website or in social media any confidential information, photographs or other material relating to Agency, the Partner(s) or this project which came to my knowledge as a result of my participation in this project; and
I acknowledge that Agency nor Partners shall not be liable for any loss, damage or injury suffered by me in connection with the Contribution or the project other than death or personal injury caused by your negligence.
8) Where I provide Agency with my personal data, I consent using it for the purposes of fulfilling this contractual agreement with me and for any additional contract administration. I understand that Agency will collect my name, address and contact information for the purpose of fulfilling this agreement.
9) Agency’s rights under this release form may be freely assigned or licensed, and I acknowledge that all rights granted to Agency under this release form are granted to Agency for the benefit of the Partners which may enforce the terms of this release form directly.
10) I acknowledge that any transfer, assignment or licence of intellectual property rights under this release is not conditional upon full or timely payment of the amounts due hereunder. The failure or delay to make any payment shall not affect, suspend or restrict Agency’s and Partners’ right to use, exploit or exercise the intellectual property rights granted or transferred under this release.
11) If a further agreement or deed of transfer is required, I am obliged to cooperate in the realization of such agreement and/or deed.
12) Agency may assign, sublicence or transfer this release form or all or any parts of its rights hereunder to any person, firm or corporation; and I agree that I shall not have the right to assign or transfer this release form.
13) Upon my request, Agency can provide me with a Dutch translation of this release.
14) This release form shall be governed by and construed in accordance with Dutch law and will be subject to the exclusive jurisdiction of the courts of my place of residence.
Participation is at the participant’s own risk. Publicis Groupe Netherlands and its partners shall not be held liable for:
14.1 Any personal injury, loss, or damage incurred during the activation;
14.2 Circumstances beyond reasonable control, including weather, operational changes, or ferry availability.
14.3 The organisers reserve the right to modify or cancel the activation if required.
